AGRAS trongly Condemned the Forcibly Arrests of Kawan Ayub, Chairperson of AGRA Chapter in Olak-olak Village, West Kalimantan

National Executive Committee of AGRA Strongly Condemned the Arrest of Kawan Ayub, Chairperson of AGRA Chapter in Olak-olak Village, Kubu Sub-district, Kubu Raya Regency, West Kalimantan Province

Violence, criminalization and various forms of human rights violations continue to intensify and massively affected the peasants and the people of Indonesia throughout the Jokowi-JK government. Almost in all regions there are land grabs through various schemes, evictions against peasants, indigenous people, fisherfolks and the broad community in the rural areas as well as evictions of the people in urban poor areas.

Through its security forces apparatus and with various accusations, Jokowi’s Adminidtration continues to suppress the peasant’s and other sectors of people’s movement, terror and intimidation, arrest and criminalization against the leaders and members of the People’s organizations.

Recently, again there was a forced and unclear legal arrest by the Mempawah Resort Police, Kubu Raya District, West Kalimantan against Ayub, Chairperson of AGRA Chapter in Olak-olak Village, Kubu Subdistrict, Kubu Raya District, West Kalimantan Province.

The arrest of Ayub took place on Tuesday 22/02/2018, at around 00.00 AM at the AGRA Office of West Kalimantan Region. Six (6) Persecuted Police officers accompanied by Mr. Junaidi, Neighborhood Chairperson of RT 001 / RW 002 Dusun Ampera Raya, Sungai Ambawang District, Kubu Raya, came to AGRA Office without using official uniform, without carrying warrant and without mentioning any purpose of their coming. They directly took Ayub forcibly who at that time found in the Chamber was resting (sleeping). They did not even introduce themselves and did not explain why and where they would bring Ayub.

In the beginning, they even asked about Wahyu Setiawan whereabouts. Wahyu Setiawan (Regional Chairperson of AGRA West Kalimantan), but because Wahyu is not in place, they ask to enter and immediately open the front room’s door of AGRA Office, where they get Ayub was sleeping, because it is already midnight.

AGRA and Ayub’ families just able to ensure those who brought Ayub were the Police Officer Mempawah District from the information gave by Mr. Junaidi when he was met at his Home by Wahyu. The head of the RT (Junaidi) also explained that previously, he had been visited twice by the Mempawah Police Officer, but did not explain anything and did not bring any warrant.

At the Mempawah Police Station Resort, Wahyu who came with Sister Esti Kristianti (The Lawyer of Ayub) was not given to meet with Ayub. The police did not even say where Ayub was detained. In fact, the purpose of their coming of Wahyu and the Lawyer is to ensure that Ayub is well and his whereabouts, and to provide legal assistance.

The National Committee of Aliansi Gerakan Reforma Agraria (AGRA) considers that the acts committed by the apparatus are forcible arrests, arbitrary acts and, acts that violate applicable legal provisions. National Committee of AGRA is also well aware that the arrest of Ayub is closely related to the land conflict between the peasant with the Oil Palm Plantation Company PT. CTB and PT. Sintang Raya which is until now has not been completed by the Government.

Throughout the case, the Farmers and the local community have continued to get intimidation, beatings, arrests and criminalization from companies that backed by the security forces and the local authorities. In 2016, the local people were even forced to leave their homes and kampongs, and then flee to the other areas for their safety.

Based on these facts, the National Executive Committee of AGRA are strongly condemns the forced arrest of Mr. Ayub conducted by the police officer of Mempawah Resort, West Kalimantan. Moreover, the arrests are conducted without valid legal procedures.

AGRA also criticized the Government of Kubu Raya Regency, the Governor of West Kalimantan Province and the entire ranks of Jokowi’s Administration who did not want to resolve the conflict between the Peasant and the communities with PT CTB and PT Sintang Raya, which continues unabated to date.

Together with this, AGRA also demands:

  1. Immediately release Ayub and stop the criminalization process against Ayub and other farmers who are in conflict with PT. CTB and PT. Sintang Raya.
  2. Demand to Jokowi’s Administration, West Kalimantan Governor, Kubu Raya Regent to immediately resolve the conflict with PT. CTB and PT. Sintan Raya which is taking place and, immediately return the land of the People

Together with this, AGRA also calls on all of AGRA Members and Leaders throughout the regions, to provide and deliver the support to release Ayub who are currently arrested and in the process of criminalization by the Mempawah Police Officers without clear legal procedures.

AGRA also calls on the Networks and other wider communities to continue to strengthen the unity, promote and advance solidarity and resist any attempts of Land Grabbing any form of human rights violations against the peasants and the broad people of Indonesia.
